By using nSmarTrac products and services, you agree to these Terms. Services are provided by NSMART, LLC (“nSmarTrac”), Pensacola, Florida, USA.
Using our services
Use nSmarTrac only as permitted by law and follow all policies we publish. Do not misuse, disrupt, or attempt unauthorized access to our platform. We may suspend or terminate access if these terms are violated.
Using our services does not transfer ownership of our software, branding, or intellectual property to you. Third-party content shown in the platform remains the responsibility of its provider.
Your account
You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately at support@nsmartrac.com if you suspect unauthorized access.
If your account is managed by an employer or administrator, additional terms may apply and that administrator may control account access.
Your content
You retain ownership of content you upload. You grant nSmarTrac the rights needed to host, process, and display that content solely to provide the services you use.
Software & updates
We may update software automatically to improve security and functionality. You receive a limited, non-exclusive license to use nSmarTrac software as part of your subscription. You may not reverse engineer, resell, or redistribute our software except where law allows.
Changes & termination
We may add, change, or discontinue features. You may stop using nSmarTrac by providing 90 days’ notice. Where practical, we will give advance notice before discontinuing a service and allow reasonable data export.
Disclaimers & liability
Services are provided “as is” to the fullest extent permitted by law. nSmarTrac is not liable for indirect, incidental, or consequential damages. Total liability for any claim is limited to fees paid for the service in the prior twelve months, or re-supply of the service at our option.
Business use
If you use nSmarTrac on behalf of a business, that business accepts these terms and agrees to indemnify nSmarTrac for claims arising from its use of the platform.
Governing law
These terms are governed by Florida law. Disputes will be resolved in state or federal courts in Escambia County, Florida. We may update these terms; continued use after changes constitutes acceptance.
