By using nSmarTrac products and services, you agree to these Terms. Services are provided by NSMART, LLC (“nSmarTrac”), Pensacola, Florida, USA.

Using our services

Use nSmarTrac only as permitted by law and follow all policies we publish. Do not misuse, disrupt, or attempt unauthorized access to our platform. We may suspend or terminate access if these terms are violated.

Using our services does not transfer ownership of our software, branding, or intellectual property to you. Third-party content shown in the platform remains the responsibility of its provider.

Your account

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately at support@nsmartrac.com if you suspect unauthorized access.

If your account is managed by an employer or administrator, additional terms may apply and that administrator may control account access.

Your content

You retain ownership of content you upload. You grant nSmarTrac the rights needed to host, process, and display that content solely to provide the services you use.

Software & updates

We may update software automatically to improve security and functionality. You receive a limited, non-exclusive license to use nSmarTrac software as part of your subscription. You may not reverse engineer, resell, or redistribute our software except where law allows.

Changes & termination

We may add, change, or discontinue features. You may stop using nSmarTrac by providing 90 days’ notice. Where practical, we will give advance notice before discontinuing a service and allow reasonable data export.

Disclaimers & liability

Services are provided “as is” to the fullest extent permitted by law. nSmarTrac is not liable for indirect, incidental, or consequential damages. Total liability for any claim is limited to fees paid for the service in the prior twelve months, or re-supply of the service at our option.

Business use

If you use nSmarTrac on behalf of a business, that business accepts these terms and agrees to indemnify nSmarTrac for claims arising from its use of the platform.

Governing law

These terms are governed by Florida law. Disputes will be resolved in state or federal courts in Escambia County, Florida. We may update these terms; continued use after changes constitutes acceptance.

How we use information

We use your information to provide, secure, and improve nSmarTrac; process payments; deliver support; send service-related notices; and, where permitted, share product updates or offers. We may contact you by phone, email, or SMS about nSmarTrac services or partner offerings related to your account.

We do not sell personal information. We may share data with trusted service providers who help us operate the platform (hosting, payments, email delivery) under confidentiality obligations, or when required by law.

Communications & consent

By submitting your information through our forms, you consent to nSmarTrac contacting you about services using automated dialing, prerecorded messages, email, or SMS where permitted by law, including for marketing. You may opt out of promotional messages at any time.

Security

We use administrative, technical, and physical safeguards, including SSL encryption for sensitive transmissions, to protect personal information. No method of transmission over the internet is 100% secure.

Children

nSmarTrac is not directed to children under 13. We do not knowingly collect personal information from children without verifiable parental consent.

Your choices

You may request access, correction, or deletion of your data where applicable. To unsubscribe from marketing emails or opt out of promotional calls/texts, email support@nsmartrac.com.

nSmarTrac has a zero-tolerance spam policy. Violations may result in warnings, suspension, or termination of your account.

Permission required

Every email or SMS recipient must have opted in or otherwise validly consented to receive messages from you. Do not import purchased, rented, or harvested lists unless you can prove opt-in consent for the type of message you send.

Email requirements

Include a working unsubscribe link in marketing emails and honor opt-out requests within 10 business days.
Use a valid reply-to address that you own or control.
Do not use deceptive subject lines, false headers, or misleading content.
Maintain complaint and bounce rates within industry standards. Excessive abuse may result in suspension.

SMS requirements

Text messages must support standard opt-out keywords (e.g., STOP). Only send SMS to recipients who have given appropriate consent under applicable law.

Prohibited activity

Sending unsolicited messages to newsgroups, forums, distribution lists, or purchased contacts.
Violating CAN-SPAM, CASL, TCPA, or other applicable anti-spam and telemarketing laws.
Messaging anyone who has unsubscribed or objected to communications.

Reporting spam

If you believe nSmarTrac is being used to send spam, report it immediately at support@nsmartrac.com and we will investigate.
